RCB sues Uber over advertisment featuring SRH batter Travis Head
Royal Challengers Bengaluru (RCB) on Thursday filed a lawsuit against Uber Moto before the Delhi High Court over an advertisement featuring Sunrisers Hyderabad (SRH) cricketer Travis Head, according to a report on LiveLaw.in.
The ad video on YouTube titled “Baddies in Bengaluru ft. Travis Head – Uber Moto | Uber” is 59 seconds long and has almost 1.4 million views, as of writing.
In the video, the Australian and SRH opening batter Head can be seen sneaking into a stadium, RCB’s home venue and spray painting the words “Royally Challenged” before Bengaluru.
Appearing for RCB, advocate Shwetasree Majumder said Uber, the commercial sponsor of SRH, was attacking the RCB. The moment a negative comment is made, there is disparagement, according to Majumder.
“You had millions of creative ways to do advertisement. Did you have to do it using my trademark? And using someone who was earlier with me? (Talking about Head who was earlier a part of the Bengaluru franchise) Does parity, fair use defence lie in the mouth of Uber Moto?” she asked.
Uber Moto, meanwhile, claimed there was a fundamental problem with the suit.
Justice Saurabh Banerjee heard both sides – Royal Challengers Sports Private Limited and Uber India & Ors. – at length before deciding to reserve judgment on the IPL side’s plea seeking interim injunction.
